
Kim Kardashian has a considerable amount of endorsement deals but Old Navy isn’t one of them and she’s making sure everyone knows it.
The 30 year-old reality TV star of Keeping Up With The Kardashians has filed a lawsuit against Old Navy’s parent company The Gap, Inc. claiming the company is creating confusion for not only using the look-alike star (Melissa Molinaro) in commercials, they are using twitter and her name to continue the charade.
“We’re seeking damages according to proof,” Kardashian’s attorney Gary Hecker told the Daily News.
“Kim Kardashian is immediately recognizable and is known for her look and style. Her identity and persona are valuable. When her intellectual property rights are violated, she intends to enforce them,” he continued.
The ads originally aired in February featuring Molinaro dancing and lip-synching to the tune “Super C-U-T-E.”
Kardashian is reported to be particularly upset over the tweets the company posted to it’s page and using her twitter account to promote the brand.
“Breaking News!! @CBSNEWS reports that Old Navy’s Super CUTE star looks like @kimkardashian. #LOL. What do you think?”
Kim’s legal reps said the ads ‘evoke her identity’ and the damages they are seeking is thought to be somewhere in the $15 to $20 million range.
“Old Navy launched a multimedia advertising campaign featuring television and online ads that misappropriate Kardashian’s likeness in the form of a celebrity look-alike, and styled the infringing ads to evoke Kardashian’s identity and persona.”
Kardashian promotes everything from perfume and jewelry to Midori Melon Liquer, Sketchers, Silly Bandz and her own clothing stores DASH. She is set to wed NBA star Kris Humphries sometime late summer.
Molinaro has since starred in the direct-to-video movie Honey 2 with The Vampire Diaries Kat Graham and is now dating Kim’s ex, Reggie Bush.
