Judge Strikes Down Gabriel Aubry Request To Lift Restraining Order
A Los Angeles judge has denied Gabriel Aubry‘s request to lift a restraining order that has been in place since a violent scuffle between him and Olivier Martinez on Thanksgiving Day.

The emergency order of protection was issued after Aubry and Martinez got into it in the driveway of Halle Berry‘s home as Aubry was dropping off their daughter Nahla. It prevented Aubry from coming within 100 yards of Berry, Martinez (Berry’s fiance) or Nahla until December 3.

Today, Aubry asked to have it cancelled immediately. While the judge pointed out that the date on the order had been entered incorrectly – it should have been set to expire on November 29 – he was not willing to remove it today. Everyone’s due back in court on Thursday for more family court fun.
