Lindsay Lohan still doesn’t know what kind of trouble she’s in for allegedly punching a Florida psychic in the face at a nightclub last fall.  At a hearing today – where Lohan did not appear, her presence being optional – New York prosecutors said they have not yet brought criminal charges against the actress.

A spokesperson for the district attorney’s office said their investigation is continuing, Reuters reported.

It’s not clear whether Lilo will ever get out of the ever-deeper hole she’s been digging for herself.  In the last few weeks of 2012, her bank accounts were seized by the IRS to cover back taxes, she was charged with three misdemeanors stemming from her June 2012 car accident, and her probation for shoplifting in 2011 was revoked.   Way to end the year on a high note!

Lindsay is due in court on January 15 to find out whether she’ll do jail time for violating her probation.
